Oceanside ADU rules

Oceanside's ADU rules are in Section 3006 of the city's Zoning Ordinance. The City Council introduced a rewrite of Section 3006 on February 11, 2026, to catch up with state law, and HCD records that it was adopted March 25, 2026 as Ordinance No. 26-OR0104-1. The rewritten section says that where it conflicts with state law, state law controls. ADUs are allowed in every zone that allows single-family or multifamily homes, on lots with an existing or proposed home.

Oceanside ADU rules in the 2026 ordinance
RuleOceanside
Detached ADU size150 to 1,200 sq ft (no cap for detached ADUs on multifamily lots under state law)
Attached ADU size150 sq ft minimum, up to 50% of the house's living area, but 850 sq ft (1,000 with more than one bedroom) is always allowed
Junior ADUUp to 500 sq ft, inside the house
Height16 ft detached; 18 ft within a half-mile walk of major transit (plus 2 ft for a matching roof pitch) or on a multistory multifamily lot; attached up to 25 ft or the zone limit, two stories max
Side and rear setbacks4 ft for an ADU up to 850 sq ft (1,000 with 2+ bedrooms) and 16 ft tall; larger or taller ADUs follow the zone
Front setbackZone setback applies to ADUs over 800 sq ft
ParkingOne space per ADU, waived within a half-mile walk of transit and in other listed cases
RentalsNo terms under 31 days, for the ADU or the main house
Separate saleNot allowed except under state law's limited exceptions

A few local rules stand out. The ordinance says ADUs and junior ADUs are not allowed alongside units built under SB 9, the state's lot-split and duplex law. It requires a recorded covenant for every ADU, a staircase serving an ADU must sit at least 4 feet from side and rear lines, and eaves may project only one foot into required yards. Existing livable space in an apartment building can't be converted to an ADU, although storage rooms, attics, basements and garages can be. State rules behind all of this are in California ADU laws, and the trade-offs between unit types are in attached vs. detached ADUs.

HCD found Oceanside's 2026 ADU ordinance non-compliant

On June 17, 2026, the California Department of Housing and Community Development sent Oceanside a findings letter saying the new ordinance fails to comply with state ADU law in 26 places. The city had until July 17, 2026 to respond with a plan to amend the ordinance or to adopt findings explaining why it disagrees. It was the second such letter in about a year: HCD's May 2025 letter had found the city's 2022 ordinance out of compliance too, including for limiting single-family lots to one ADU.

The findings that matter most to homeowners:

  • The 50% rule. The ordinance caps an attached ADU at 50% of the house. HCD says that cap can't push an ADU below 850 sq ft, or 1,000 sq ft with more than one bedroom.
  • Height and setbacks. Several sections send ADUs taller than 16 feet back to the zone's height and setback rules, including an ADU over a garage. HCD says ADUs are entitled to the state's 16, 18, 20 or 25 ft height allowances with setbacks of no more than 4 feet.
  • Covenants. HCD calls the covenant requirement a prohibited extra standard for ADUs that aren't sold separately.
  • Parking. A studio ADU with no bedroom can't be required to have a parking space, and losing an uncovered space to an ADU doesn't require a replacement.
  • Combinations. A junior ADU can be combined with the full number of ADUs state law allows, and an ADU can be built inside an apartment building's existing living space under state law.
  • Junior ADUs. A JADU can't be in a detached accessory structure, and one without its own bathroom needs an interior door to the house. The owner doesn't have to live on site if the JADU has its own bathroom.
Where the city and the state disagree, ask which rule applies. We couldn't find Oceanside's response to HCD or a later amendment. The ordinance itself says state law controls in a conflict, so if a design is blocked by one of the provisions HCD flagged, raise the letter with Development Services before you redesign. If you want a junior ADU, see our junior ADU guide.

Can you use an Oceanside ADU as a short-term rental?

Generally no. The city's short-term rental program says that if an ADU was permitted on or after September 9, 2017, neither the ADU nor the main house can be used as a short-term rental. The 2026 ordinance adds that neither unit may be rented for less than 31 days. ADU rental income in Oceanside comes from monthly or longer leases; see ADU rental income in San Diego.

Building an ADU in Oceanside's coastal zone

Part of Oceanside is in the coastal zone, where ADU rules sit inside the city's Local Coastal Program. The 2026 ordinance takes effect in the coastal zone only after the California Coastal Commission certifies the matching amendment, LCPA25-00002. Once it does, coastal ADUs need no public hearing, the city must act on a complete Coastal Development Permit application within 60 days, and that permit can't be appealed to the Coastal Commission. Converted garages and ADUs above garages in the coastal zone must also respect habitat buffers and geologic setbacks. We couldn't confirm whether certification has happened, so ask the city which rules apply on a coastal lot.

SnapADU, an ADU builder, reports from its own Oceanside projects that some coastal ADUs need a Coastal Development Permit but no hearing, and that coastal permits have taken about as long as others.

Getting an Oceanside ADU permit

ADU permits go through Oceanside's Development Services Department at 300 N. Coast Highway. Under the 2026 ordinance, the city has 15 business days to decide whether your application is complete and 60 days to approve or deny it, matching the state's deadlines. An ADU submitted with a new house won't be approved before the house is. SnapADU reports that Oceanside accepts digital ADU applications, may ask for a soils report case by case, and requires a form board certification before concrete is poured. The builder puts typical permitting at 3 to 4 months.

Common questions

Can I build an ADU in Oceanside?
Yes. Oceanside allows ADUs in every zone that allows single-family or multifamily homes, on lots with an existing or proposed home. A detached ADU can be up to 1,200 sq ft, and a junior ADU up to 500 sq ft.
Is Oceanside's ADU ordinance compliant with state law?
Not according to HCD. On June 17, 2026, the state housing department found the ordinance adopted March 25, 2026 out of compliance in 26 places, including the 50% size rule, height limits, setbacks, parking and covenants. The ordinance says state law controls where they conflict.
Can I use my Oceanside ADU as a short-term rental?
No, if the ADU was permitted on or after September 9, 2017. In that case neither the ADU nor the main house can be a short-term rental, and the 2026 ordinance bars rentals under 31 days.
What are Oceanside ADU fees?
The 2026 ordinance says the city charges no impact fees on ADUs or JADUs. Oceanside Unified's school fee is $4.79 per sq ft, with no fee under 500 sq ft, and new ADUs may need a proportionate water or sewer connection.
Do I need a coastal permit for an ADU in Oceanside?
Possibly. ADUs in Oceanside's coastal zone follow the Local Coastal Program, and the 2026 ordinance only applies there once the Coastal Commission certifies it. Ask Development Services whether your lot needs a Coastal Development Permit.
